Agenda Item Summary:
A request was received in the Engineering Office on September 10, 2024 requesting the requirement to install sidewalk at Apple Valley Subdivision per City of Rapid City Municipal Code (RCMC) 16.16.050(A) be waived. The property owners are developing this property for a residential subdivision. RCMC 16.16.050(A) requires all internal lots that are within the City’s 3-mile platting jurisdiction have sidewalk installed. Since the lots are located in the County, the City does not issue building permits, the usual mechanism for ensuring sidewalks are installed. The requested variance will allow for development of Phase 2 of the subdivision without the installation of sidewalk. On similar developments as this one, the homebuilders install the sidewalk. Developer is responsible for sidewalk at intersections including accessible handicap ramps, unbuildable lots and previously platted and/or developed lots. City Council approved a sidewalk variance for Phases 1A-1C on February 5, 2024. The applicant is also requesting a variance for all future phases of the project. The time line for the entire build-out of the site is approximately 10 years or greater. City Ordinance does say that if no work is completed or improvements made, the variance expires after 2 years. Public Works reached out to Pennington County Planning and they are opposed to granting a variance for the entire subdivision. Public Works recommends approving for Phase 2 only with the stipulation that a new variance request be submitted for each future phase.
