Agenda Item Summary:
On November 25, 2019 the applicant submitted a Request for Exception to Sections 2.14.4 of the City of Rapid City Infrastructure Design Criteria Manual (IDCM) to waive the requirement to waive/defer the requirement to pave proposed subdivision streets until a road district is created and funds accumulated. The Exception Request was submitted in conjunction with a preliminary subdivision plan application to the Current Planning Department. The request is for approximately 3,400 feet of road over three phases of construction. The proposed subdivision is outside of the City limits but within the City’s three mile platting jurisdiction. Language in the City’s Development Agreement requires that prior to the filing of a final plat, the developer shall provide the City surety in the form of cash, irrevocable letter of credit or performance bond for any improvements not completed at the time of application. The Exception Request was denied by Public Works on December 16, 2019; see attached Exception Request. On December 23, 2019 the applicant submitted an appeal request. Public Works recommends denial of this request.
