Agenda Item Summary:
A request was received in the Engineering Office on May 10, 2018 requesting the requirement to install sidewalk along Fountain Plaza Drive per City of Rapid City Ordinance 12.08.060 be waived. A five-foot wide sidewalk is required to be constructed along Fountain Plaza Drive at the time of building permit, with the property having approximately 340 feet of frontage along Fountain Plaza Drive. The requested variance will allow for construction of a new commercial building on the property without the installation of sidewalk in the adjacent Fountain Plaza Drive right-of-way. Adjacent Fountain Plaza Drive is a commercial street with no curb and gutter and a rural street section with ditches to accommodate drainage. Fountain Plaza Drive is currently void of sidewalk, except on one parcel approximately 760 feet south of the property. Fountain Plaza Drive at this location is an urban street section with curb and gutter, which is more accommodating for the installation of sidewalk. There is one option for sidewalk; install five-foot wide sidewalk one foot inside the right-of-way. Given that Fountain Plaza Drive is a rural street section, it seems reasonable to allow a variance to the sidewalk until the street is reconstructed to City Standards. Public Works recommends approval of the sidewalk variance request. The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
