Agenda Item Summary:
This project is being funded by a State Revolving Fund (SRF) Loan. As such all contracts and contract change orders must be approved by the South Dakota Department of Environment and Natural Resources (SDDENR). The originally approved change order contained liquidated damages for this project. The SDDENR does not allow contract change orders to contain liquidated damages. Therefore, the original change order must be rescinded and this change order approved in its place. Liquidated damages will still apply to this contract. However, instead of documenting the liquidated damages in a change order the liquidated damages amount ($8,800.00) will be deducted from Mainline Contracting Inc.’s final project payment application.
