Agenda Item Summary:
A request was received in the Engineering Office on May 3, 2018 requesting the requirement to install sidewalk along South Berry Pine Road per City of Rapid City Ordinance 12.08.060 be waived. A 4’ wide sidewalk is required to be constructed along South Berry Pine Road at the time of building permit, with the property having approximately 70’ of frontage. The requested variance will allow for the construction of a single family residential house, without the installation of sidewalk in the adjacent right-of-way, associated with building permit CIBP16-2681.
Adjacent South Berry Pines Road is a local residential street, with no sidewalk on the south / west side of the road of which this lot is located and a 5’ connected sidewalk along the north / east side of the road, with a rural pavement section with ditches to accommodate drainage.
South Berry Pines Road serves a developed residential area with all lots void of any sidewalk on the south / west side of the road and not graded for sidewalk installation. A connected sidewalk corridor is unlikely on the south / west side of the road unless the City Council should order in sidewalk for the street as future building permits are not anticipated as adjacent lots are already built on. A sidewalk variance was granted to 723 South Berry Pine Road located 2 lots south of this requested variance by City Council on 6/16/2014.
The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
