Agenda Item Summary:
A request was received in the Engineering Office on November 13, 2017 requesting the requirement to install sidewalk along Dyess Avenue per City of Rapid City Ordinance 12.08.060 be waived. A five-foot wide sidewalk is required to be constructed along Dyess Avenue at the time of building permit, with the property having approximately 900 feet of frontage along Dyess Avenue. The requested variance will allow for construction of a building expansion on the property without the installation of sidewalk in the adjacent Dyess Avenue right-of-way. Adjacent Dyess Avenue is two lane minor arterial with no sidewalk and a rural street section with ditches to accommodate drainage. Dyess Avenue is currently void of pedestrian access routes. The nearest sidewalks are located on Seger Drive at intersection with Dyess Avenue, approximately 3,000 feet south from the subject property. Installation of sidewalk is not conducive with the existing rural road section.
There is one option for sidewalk; install five-foot wide sidewalk one foot inside the right-of-way.
A sidewalk variance request was approved for the subject property with a waiver of right to protest (WORP) by Council on 11/05/12. A sidewalk variance request was approved with a WORP for 3356 Dyess Avenue, located directly south of the subject property by Council on 6/18/12. A sidewalk variance request was approved with a WORP for 3030 Dyess Avenue, located approximately 1,400 feet south of the subject property by Council on 4/06/15. A sidewalk variance request was approved for 3010 Dyess Avenue, located approximately 1,700 feet south of the subject property by Council on 6/01/15.
Based upon the rural nature of this site and the lack of pedestrian traffic in the area, it seems reasonable to allow a variance to the sidewalk requirement until development in the area necessitates construction of an urban street section and sufficient right-of-way is dedicated along Dyess Avenue. The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
