The petitioner applied for an exception request to allow connection to an existing non-conforming water service stub that runs parallel in the ROW, in front of an adjacent lot for a new single family house. Staff denied the exception request based on the following. A water service stub was constructed to Lot 22, Block 1 of Tyler Knue Subdivision when the Nicole Street improvements were originally constructed in 2001. Since that time, it appears that that this lot has been re-platted 2 times. With the replatting of the property, the previously constructed water service became non-conforming as now it is tapped to the public water main in front of an adjacent lot, and today the service also runs parallel in the right-of-way. No structure has been constructed on the lot until a recent building permit was obtained for a new single family residence. IDCM Section 3.15.1.2 requires “All water and sewer lines, including private systems, must run at right angles to the street and may not run in the ROW parallel to the street. Service lines shall not cross adjoining property lines and shall connect to mains fronting the property.” The existing lot as it stands today has frontage to a public water main, therefore it is not appropriate to allow connection to a water service that is non-conforming to the City’s design standards with a new building permit. The existing non-conforming water service stub must be abandoned at the main and a new service constructed to the lot that fronts the parcel, per City Standards. The petitioner is appealing the Staff denial to the City Council.
