Agenda Item Summary:
A request was received in the Engineering Office on 4/17/2017 requesting the requirement to install sidewalk along Haines Avenue per City of Rapid City Ordinance 12.08.060 be waived. A 10’ sidewalk is required to be constructed along Haines Avenue at the time of building permit, with the property having approximately 335’ of frontage along Haines Avenue. The south/west side of Haines Avenue is an identified route for a side path within the City’s Bicycle and Pedestrian Master Plan adopted by the City in 2011, requiring the 10’ wide sidewalk. The requested variance will allow for the construction of 48 unit apartment complex on the current undeveloped lot, without the installation of sidewalk in the adjacent right-of-way. Adjacent Haines Avenue is an arterial street with no sidewalk with a posted speed limit of 50 mph, and has a rural street section with ditches to accommodate drainage. It should be noted that this lot is located inside City limits, however the adjacent Haines Avenue right-of-way is located outside of City limits. Sidewalk construction would interfere with the existing drainage ditch and there would be concerns with constructing the sidewalk at the bottom of the ditch. There are no current plans to improve Haines Avenue. The nearest sidewalk is located within the portion of Haines Avenue constructed with curb and gutter to the south of this property approximately 760’ as an 8’ side path. There is also sidewalk 820’ to the north at the Cobalt Drive and Haines Avenue intersection. The construction of sidewalk with this project would not create a connected sidewalk corridor. Pedestrian movements from the 48 unit apartment complex are anticipated to travel from the apartments to the south towards the City. However, until such time as Haines Avenue is constructed with curb and gutter and a protected corridor provided for pedestrians away from the pavement, the sidewalk does not seem appropriate to construct to encourage pedestrian movements. The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
