Agenda Item Summary:
The petitioner has requested an approach off of Pinedale Circle within City limits at the location of unimproved section line right-of-way for access to SW¼SW¼ Less Lot A, Section 32, T2N, R7E, which is outside City limits. From the section line, a driveway extension onto the property will require an embankment approximately 30’ in height through a draw that is immediately upstream of Rapid City limits, with 20,000 cubic yards anticipated for fill to construct the driveway. The petitioner has indicated that the majority of the fill material will come from the property. Staff approved of an exception request to not improve the section line to full street improvements and allow for asphalt the first 50’ of the section line right-of-way, contingent upon the property owner entering into a Covenant Agreement with the City requiring property owner to maintain the section line right-of-way and to allow this as access to a single family residence only. The petitioner has provided construction plans for the pavement within the section line right-of-way in the City and the driveway in the County that generally meet City Standards. The previous owner of the property had secured access through properties to the north, however that agreement was never fulfilled. The petitioner has indicated that access at this location is the preferred location to access the parcel, despite the large amount of fill material required. If approved, staff recommends approval be conditioned on the following stipulations: (1) All work is performed according to approved plans; (2) Execution of a Covenant Agreement for Road Maintenance; (3) Execution of a Haul Route Agreement.
