Agenda Item Summary:
A request was received in the Engineering Office on September 2, 2016 requesting the requirement to install sidewalk along Elk Vale Road per City of Rapid City Ordinance 12.08.060 be waived. A 5-foot wide sidewalk is required to be constructed along Elk Vale Road at the time of building permit, with the property having approximately 340 feet of frontage along Elk Vale Road. The requested variance will allow for construction of a new convenience store on the property without the installation of sidewalk in the adjacent Elk Vale Road right-of-way. Adjacent Elk Vale Road is a principal four-lane arterial street with no sidewalk and ditches to accommodate drainage. Elk Vale Road is currently void of sidewalk. There is an approximately 8 foot wide paved shoulder adjacent to the travel lane, but this would not be considered protected for pedestrian access. The existing steep topography is not conducive to construction of a sidewalk. There is existing 5 foot wide sidewalk along the property’s frontage on Highway 44. There are two options for sidewalk; install 5-foot wide sidewalk 1 foot inside the right-of-way or install 5-foot wide sidewalk adjacent or near to Elk Vale Road. Public Works recommends approval of the sidewalk variance request.
