Agenda Item Summary:
The petitioner applied for an exception request to waive the requirements to provide pavement, curb, gutter, sidewalk, street light conduit, water and sewer in the access and utility easement along the east lot line and dedicate right-of-way (City File 16EX075). Staff denied the exception request based on the following. Subdivision improvements including pavement, curb, gutter, sidewalk, street light conduit, water main and sewer main are triggered during the platting process for all adjacent roadways. The proposed plat (City File 16PL013) has frontage to the access and utility easement for approximately 560’, of which provides access from Moon Meadows Drive to Sammis Trail. The access and utility easement aligns with a collector street located on the north side of Moon Meadows Drive, which is known to be the future Healing Way. Staff believes that this connection from Moon Meadows Drive to Sammis Trail is the appropriate place for the permanent connection to Moon Meadows Drive to remain, creating a 4-legged intersection. This easement was dedicated as the new access to Sammis Trail as a part of the Moon Meadows Drive construction project (City File DEV12-1087), to eliminate an approach along US Hwy 16. With the construction of Moon Meadows Drive, the developer was only required to provide an equivalent pavement surface to the existing for the connection to Sammis Trail so a 24’ wide gravel surfacing was all that was required. As this will be a public street connection it is appropriate for it to be located within dedicated right-of-way. A sewer main is master planned to be extended in this location to serve the property to the south. Locating the sewer main in any other location would compromise how much area can be served by the sewer as we are near the end of the service basin. A 12” sanitary sewer was stubbed at the intersection of Moon Meadows Drive and this easement to be extended to the south through the easement. For water, a water main is master planned to be extended in a location near the access easement to serve the property to the south and ultimately connect to a future water reservoir to service the Skyline Water Pressure Zone. Even though access and utilities for the proposed plat is planned to come from Moon Meadows Drive, as the street is adjacent to the proposed plat the property owner is still responsible to extend the improvements across the full frontage of their property so that they are available to neighboring properties. The petitioner was appealing the Staff denial to the City Council, however that appeal has since been withdrawn.
