Agenda Item Summary:
TMA, LLC has submitted a Major Amendment to a Planned Development Overlay to allow a mixed use development at 329 Main Street (City File 16PD007); approved by Planning Commission on March 24, 2016. As part of the building renovation process, upgraded electrical service hardware needs to be installed in the rear of the building, where there is a zero foot setback to the adjacent alley. As such, the electrical equipment will encroach into the public right-of-way without unduly interfering with use of the right-of-way. A covenant agreement to be filed at the Register of Deeds is required to protect both the City’s and Landowner’s interest.
