Agenda Item Summary:
The applicant is proposing to vacate a 0.12 acre portion of right-of-way located at the eastern terminus of East Madison Street, east of Spruce Street. North Cherry Street and East Madison Street are classified as Local streets in the Infrastructure Design Criteria Manual. The Infrastructure Design Criteria Manual specifies a minimum 52-foot right-of-way width for Local streets. The proposed vacation of right-of-way will continue to maintain sufficient right-of-way along East Madison Street, currently 80 feet in width. A Permanent Utility Easement has been granted in a portion of the right-of-way proposed to be vacated. Additionally, an H-Lot has been dedicated and accepted by the City Council to allow the future construction of a cul-de-sac at the eastern terminus of East Madison Street. All adjacent properties will have access from the existing street network. As such, vacating the right-of-way will not adversely impact adjacent properties. Written concurrence from the utility companies has been received by the owner as a part of this application.
