Agenda Item Summary:
The applicant has submitted an Annexation request for an 8.31 acre property addressed as 7380 Muirfield Drive. The property is contiguous to the Rapid City Corporate limits. The City Council approved Preliminary Subdivision Plan (#23PL014) to create three residential lots and one commercial lot on April 3, 2023. The lots range in size from 1.31 acres to 3.67 acres and are to be known as Lots A through D of Red Rock Shadows No. 2 Subdivision. A single family residence is located on proposed Lot B and 3 mini-warehouse structures are located on proposed Lot D. Lots A and C are currently void of any structural development.
Chapter 16.04.090 requires that property adjacent to the City limits be annexed prior to submission of a Final Plat application. The City’s annexation policy sets forth goals through its annexation requirements to achieve orderly growth, the provision of urban services, health and safety measures, and an equitable tax base. Typically, these goals are met for property adjacent to City limits.
This property is located within the Whispering Pines Volunteer Fire District. This Volunteer Fire Department has certified outstanding debt with the City of Rapid City that would enable payment from the City to the Fire District upon annexation pursuant to SDCL 34-31A-35 and Section 3.20 of the Rapid City Municipal Code. The District has requested the City to reimburse the property’s share of outstanding debt in the amount of $9582.79, to be levied against the property, in order to prevent the loss of revenue to the Fire District upon annexation. Once annexed, the property will be under the jurisdiction of the Rapid City Fire Department.
The property is currently zoned Planned Unit Development by Pennington County. Pennington County’s Future Land Use Plan designates this site as Low Density Residential. The City’s Future Land Use identifies the subject property as appropriate for Urban Neighborhood development. The property is located within the City’s Urban Services Boundary. The subject property does not hinder orderly growth, create health or safety issues, or an inequitable tax base.
Once annexed, the property will be zoned No Use District. The applicant has submitted an associated Rezoning application to change the zoning of the property from No Use District to General Commercial District for Lot D (File # 23RZ007), and a Rezoning application (Files # 23RZ008) to change Lots A-C from No Use District to Low Density Residential District.
