Agenda Item Summary:
The applicant has proposed to vacate a portion of a 66-foot wide section line highway located between Section 19 and Section 30 in the City of Rapid City on property owned by the City , west of South Dakota Highway 79. The section line highway is located within and adjacent to the operations area of the permitted landfill. The entire section is not proposed to be vacated, due to a power line easement at the west boundary of the proposed area of vacation, and a South Dakota Department of Transportation maintenance yard located at the east boundary. Allowing public access onto the section line highway creates a safety hazard and impedes the operation of the landfill. Vacating the section line highway helps ensure the long term viability of the regional investment in the City’s Solid Waste Division.
The section line highway is not identified as an arterial or collector street on the City’s Major Street Plan. All adjacent properties have alternative access. As such, vacating the section line highway will not adversely impact adjacent properties. No utilities are located within the section line highway and written concurrence from the utility companies has been received by the owner as a part of this application.
