Agenda Item Summary:
The applicant has applied to vacate a portion of the section line highway located east of North Valley Drive and East Philadelphia Street. All adjacent properties will have access from alternative streets as identified on the City’s Major Street Plan. In addition, the section line highway is not needed as a utility or drainage corridor. As such, vacating the section line highway will not adversely impact adjacent properties. An overhead transmission line is located within the section line highway and written concurrence has been received by the owner as a part of this application. No changes are proposed to the existing easement used to maintain the transmission line. On June 20, 2022, the Planning Commission approved a Preliminary Subdivision Plan for Shepherd Hills South Subdivision (#22PL053) with the stipulation that upon submittal of a Development Engineering Plan application, the plat document shall show the vacation of the section line highway or the lot layout shall be revised to ensure building envelopes on all the lots impacted by the section line highway. The Rapid City Municipal Code states that all principal and accessory buildings and structures shall be setback no less than 58 feet from any section line. Vacating the section line allows for buildable sites for the eastern lots in the Shepherd Hills South Subdivision.
