Agenda Item Summary:
The applicant has submitted a Variance request to reduce the side yard setback to 10 feet in lieu of 35 feet and to omit the paving requirement for the property located east of the intersection of Hidden Timber and Horse Creek Road. The subject property is owned and maintained by the Spring Brook Acres Homeowners Association and was designated as a neighborhood use lot when the subdivision was developed and the association incorporated in 1972. The property was annexed into the City limits of Rapid City in 1978, at that time, recreational vehicles were being parked and/or stored on the property as a legal non-conforming use. As such, the use may continue as a legal non-conforming use on the property as per Chapter 17.52 of the Code. The applicant should be aware that if the legal non-conforming use is discontinued for a period of one year, or changed, any future use of the property must be in conformity with the provisions of the Mobile Home Residential District.
