The applicant has submitted a Conditional Use Permit to allow an oversized garage on 1229 Santana Court. The property is comprised of 5.17 acres of undeveloped land zoned Low Density Residential District. The applicant is proposing to construct a two-story single-family dwelling on the southwest corner of the property. The main level of the structure will be 1,987 square feet in size and will consist of garage and shop space, the upper level of the dwelling will be 1,170 square feet in size and will consist of living area. The dwelling is proposed to have a gross floor area of 3,157 square feet. Chapter 17.04.315 of the Rapid City Municipal Code states that the maximum cumulative size of all private garages shall be 1,500 square feet or 30% of the size of the gross floor area of the dwelling unit, whichever is greater. For this property, 1,500 square feet exceeds 30% of the gross floor area of the dwelling unit, therefore, all areas dedicated to parking or storage which exceed a cumulative size of 1,500 square feet may only be allowed as a Conditional Use Permit. The cumulative size of all proposed areas dedicated to parking and storage is 1,987 square feet which exceeds the maximum size allowed by 487 square feet. Chapter 17.50.270.I of the Code states that the hard surface improvements on driveways must begin at the street or curb line, and either extend to the garage or parking slab or a minimum of 50 feet. The site plan submitted does not identify hard-surfaced improvements and as such upon submittal of a Building Permit the site plan must be revised to show a hard surface on the first 50 feet of the driveway.
