Update: 10/19/22 – This item was continued to the October 27, 2022, Planning Commission meeting so that publication requirements could be met. All revised text is shown in bold). The applicant has submitted a Major Amendment to a Planned Development Overlay to allow on-sale liquor in conjunction with a restaurant. The Mexican-themed restaurant will have a gross floor area of 4,917 square feet and will occupy the northern suite of a newly constructed 10,535 square-foot strip mall. The business will include three dining areas and a bar and will have a seating capacity of 132 people and a maximum occupancy of 187 people. No outdoor seating is being proposed as part of this application. The anticipated opening date is between January and April of 2023 and the proposed hours of operation are 11:00 am to 9:00 pm Sunday through Thursday and 11:00 am to 10:00 pm Friday and Saturday. As indicated in the letter of intent, the applicant has over 10 years experience in the restaurant business and has managed a liquor license since 2019 with no infractions. On August 26, 2021, the Planning Commission approved a Final Planned Development Overlay to allow a strip mall on the property with the stipulation that all Conditional Uses in the General Commercial District shall require a Major Amendment to the Final Planned Development Overlay. On-sale liquor establishments are considered a Conditional Use in the General Commercial District. As of September 29, 2022, the required public notification sign and letters have not been picked up by the applicant. As such, the public notification requirements can not be met. Staff recommends that the Major Amendment to a Planned Development Overlay to allow on-sale liquor in conjunction with a restaurant be continued to the October 27, 2022 Planning Commission meeting. Publication requirements have since been met.
