Agenda Item Summary:
The applicant has submitted a Major Amendment to a Planned Development Overlay to allow the on-sale of liquor in conjunction with an art store at the Uptown Rapid Mall located at 2200 North Maple Avenue. The applicant intends to operate the business in Suite 562A which is an interior unit that is 4,648 square feet in size and located in the northern portion of the mall. The business, known as “Happy Hills Painting” will involve art painting classes, crafting instruction, and workshop space. The layout of the unit will include a primary art instruction classroom, an extended instruction classroom, a lounge area, and a customer service counter. Retail will be an accessory component of the business and will include the sale of artwork, canvases, paper products, and an assortment of other art-orientated supplies. The counter area, primary entrance, and rear exit will be clearly signed indicating alcohol-related restrictions. Included in this signage is the advisory that alcohol products purchased on-site must be consumed within the facility or disposed of on-site. The hours of operation comply with the Uptown Rapid Mall policy of opening no earlier than 10 am and closing no later than 9 pm. The Uptown Rapid Mall is a Regional Activity Center with a Reinvestment Focus. The City’s Comprehensive Plan recommends introducing additional commercial service uses. The proposed Major Amendment to the Planned Development Overlay at the Uptown Rapid Mall is consistent with the City’s adopted Comprehensive Plan.
