Agenda Item Summary:
The applicant has submitted a Major Amendment to a Planned Development Overlay application to allow a medical cannabis dispensary located at 1624 Discovery Circle. The property is currently void of structural development. The applicant is proposing to construct a 4,000 square-foot building with two suites for the medical cannabis dispensary and a cannabis accessory store. The medical cannabis dispensary will consist of a 2,750 square-foot suite, and the cannabis accessory store will be located in a 1,250 square-foot suite. The applicant has indicated that the medical cannabis dispensary and cannabis accessory store, to be known as CC Health, will be open daily from 8 a.m. to 10 p.m. The applicant previously applied for a Conditional Use Permit to allow a Medical Cannabis Dispensary at this location (File #21PD041). That application was approved by Planning Commission on November 24, 2021 and was subsequently appealed to City Council. On December 20, 2021, City Council denied the appeal, thereby affirming the approval by Planning Commission. The applicant is proposing to increase the size of the building from 2,516 square feet to 4,000 square feet, and to alter the site layout. The subject property is zoned General Commercial District but is located within a Planned Development Overlay. As such, the applicant has submitted this Major Amendment to a Planned Development Overlay application for the review and approval by the Planning Commission. In reviewing this location, the Planning Commission must determine if the proposed use is compatible with the existing development within the area and ensure that the use at this location does not create a saturation of similar uses within this area of our community.
