Agenda Item Summary:
The applicant has submitted a Conditional Use Permit application to allow a medical cannabis dispensary at 230 E. North Street. There is currently a 1,500 square-foot commercial building operating as a casino located on the property. The applicant has indicated that the medical cannabis dispensary, to be known as Genesis Farms, will be open Monday through Saturday from 10:00 a.m. to 8:00 p.m. Staff has reviewed the Conditional Use Permit to allow a medical cannabis dispensary pursuant to Chapter 17.18, Chapter 17.50.105 and Chapter 17.54.030 of the Rapid City Municipal Code and the goals, policies, and objectives of the adopted Comprehensive Plan. The subject property is located adjacent to a residential district. The proposed dispensary is separated from the residential use by a 6-foot high chain link fence with slats and the alley. The back of the proposed dispensary faces the back of the existing apartment building, and no signage will be visible from the residential use. On November 24, 2021, Planning Commission approved a Conditional Use Permit to allow a medical cannabis dispensary at 918 E. North Street, which is approximately 3,150 feet from the subject property
