Agenda Item Summary:
The applicant has submitted a Conditional Use Permit application to allow a medical cannabis dispensary at 608 Saint Joseph Street. There is currently a 4,982 square-foot commercial building located on the property. The applicant is proposing a Medical Cannabis Establishment in a 2,500 square-foot suite. The applicant has indicated that the medical cannabis dispensary, to be known as Genesis Farms, will be open Monday through Saturday from 10:00 a.m. to 8:00 p.m. Staff has reviewed the Conditional Use Permit to allow a medical cannabis dispensary pursuant to Chapter 17.18, Chapter 17.50.105 and Chapter 17.54.030 of the Rapid City Municipal Code and the goals, policies, and objectives of the adopted Comprehensive Plan. The proposed medical cannabis dispensary appears to be sufficiently buffered from the existing park and church uses. The proposed dispensary location will not be visible from the park or the church. The applicant has also submitted an application (21UR050) for a Conditional Use Permit to allow a medical cannabis dispensary on the adjacent property. As such, Staff is recommending that only one building permit be issued for 608 Saint Joseph Street or 610 Saint Joseph Street to limit potential saturation in this area. Additionally, on November 24, 2021, Planning Commission approved a Conditional Use Permit to allow a medical cannabis dispensary at 631 Main Street (21UR035), which is located approximately 500 feet from the subject property. The previously approved Conditional Use Permit location is not visible from the subject property.
