Agenda Item Summary:
The applicant has submitted a Conditional Use Permit application to allow a medical cannabis dispensary located on the east side of Tower Road, south of the intersection of Tower Road and Skyline Drive. The property is currently devoid of structural development. The applicant has indicated that the propose 1,500 square-foot medical cannabis dispensary, to be known as Black Hills Cannabis Care, will be open daily from 10:00 a.m. to 7:00 p.m. Staff has reviewed the Conditional Use Permit to allow a medical cannabis dispensary pursuant to Chapter 17.18, Chapter 17.50.105 and Chapter 17.54.030 of the Rapid City Municipal Code and the goals, policies, and objectives of the adopted Comprehensive Plan. The subject property is located approximately 120 feet from a residential district and adjacent to legal non-conforming residence on the lot zoned General Commercial District to the north, but the proposed dispensary and signage will not be visible from the residential district and the existing residence due to vegetation and a significant difference in elevation.
