Agenda Item Summary:
The subject property consists of 43 acres that are contiguous to the Rapid City Corporate limits. This property is currently being platted into two residential lots. Chapter 16.04.090 requires that property adjacent to the City limits be annexed prior to submission of a Final Plat application. The City’s annexation policy sets forth goals through its annexation requirements to achieve orderly growth, the provision of urban services, health and safety measures, and an equitable tax base. Typically these goals are met for property adjacent to City limits, necessitating the annexation. The property owner has requested the annexation requirements be waived. City staff supports waiving the requirement to annex given that annexation of the property does not achieve the annexation goals set forth in the City’s policy. Furthermore, annexation of the property may require that Cabot Hill Road become part of the City’s future roadway network which is an undesirable liability due to the condition and terrain of the road.
