Agenda Item Summary:
The applicant has submitted a Variance request to reduce the minimum required side yard setback from 8 feet to 3.3 feet for an existing dwelling. The structure was built in the wrong location by the original builder in 1995. The current property owner is proposing to construct an attached garage on the north side of the dwelling but a permit cannot be issued when there is an existing noncompliant setback. A Vacation of Utility and Minor Drainage Easement (File #20VE009) was approved for the existing encroachment. The property is currently developed with a 1½ story structure measuring 1,067 square feet in size.
