Agenda Item Summary:
The applicant requests to de-annex a 1.17 acre parcel of land from the Rapid City corporate limits. The property is located south of the I-90 Service Road and east of North Elk Vale Road. It is adjacent to the Box Elder City limits. The subject property is zoned General Commercial District and is developed with a restaurant (Perkins), hotel (Fairfield Inn), and indoor water park (WaTiki). There is a proposal to expand the water park development onto property within the City of Box Elder. It is not cost effective to expand City utilities in order to accommodate the water park expansion. Furthermore, the City of Box Elder already has water and sewer utility capacity to support the expansion of the water park, available at the eastern boundary of the expanded project site. If the subject property is de-annexed, the applicant has agreed to annex into the Box Elder City limits. An agreement titled “Agreement Between the City of Rapid City, the City of Box Elder, and Atlantis, LLC for De-annexation, Annexation, and Development of Property” further establishes an understanding among the parties related to the proposed de-annexation.
