This Item was continued from the September 5, 2019 Zoning Board of Adjustment at the applicants request. The City received numerous complaints about the Stagecoach West LLC Signs located at 4110 Mount Rushmore Road. After reviewing the site in the spring of 2019, it was determined that the signs were unlawful and needed to be removed. Staff observed the signs several times in May and June. Based on the observations a violation notice was sent declaring the signs unlawful and ordering the removal of the signs. The original sign on the south confirmed to Rapid City Sign Code for off-premise signs when initially installed, however, subsequent revisions and upgrades made after the Sign Code was updated render it non-confirming except for spacing and has been deemed unlawful and subject to removal. Around 2005 an application for an off- premise sign was submitted for the north sign which was denied and subsequently Appealed to the City Council where only the height variance from 30’ to 37’ was granted and the sign was approved as an on-premise sign only. However, the north sign has been used as an off-premise sign without an approved Conditional Use Permit or required credits, is over height and size and as such has been deem unlawful and subject to removal.
