On October 25, 2018, the Planning Commission continued the Rezoning request to allow staff to re-advertise the request with a corrected title. The notification letters and newspaper publication have been corrected. As such, staff recommends that the Rezoning request from General Commercial District to Office Commercial District be approved. No other changes have been made to this report. (Update September 21, 2018. All revised and/or added text is shown in bold.) On September 20, 2018, the Planning Commission continued the Rezoning request to the October 25, 2018 Planning Commission meeting to allow the request to be re-advertised and to allow the applicant to address the code violation on the property. The code violation has been resolved. The public notification requirement has been met. Staff recommends that the Rezoning request from General Commercial District to Office Commercial District be approved. The applicant originally submitted a Rezoning request from General Commercial District to Medium Density Residential District for a parcel of land approximately 0.53 acres in size. On September 6, 2018, staff discussed with the applicant amending the Rezoning request to be in compliance with the future land use designation of Mixed-Use Commercial and an outstanding zoning code violation on the property. Subsequently, the applicant has requested that the Rezoning request be changed to Office Commercial District. In addition, the Building Official has identified that there is a zoning code violation on the property regarding the storage of construction equipment. To allow for the re-publication of the revised Rezoning request and to allow the applicant to address the outstanding code violation on the property, staff recommends that the Rezoning request be continued to the October 25, 2018 Planning Commission meeting.
