Agenda Item Summary:
Community Development staff, Henriksen Inc., the Historic Preservation Commission (HPC), the State Historic Preservation Office (SHPO) staff, and the property owners have reviewed plans for proposed alterations to a historic structure pursuant to SDCL 1-19A-11.1 and RCMC 17.54.080. Over the course of this process, three project proposals have been submitted – each proposal improving in its conformance with the Secretary of the Interior’s Standards for Rehabilitation. Following the SHPO’s comments on the second project revision, the applicant voluntarily submitted a third project proposal which responds to the recommendations of the SHPO, HPC, and Community Development staff. Of the three proposals, the third project revision, 11/30/17, does the best job of demonstrating best practices for rehabilitation of historic structures. More information is provided in the Staff memo and attached links. The applicant withdrew their appeal at the 12/27 Legal Finance Committee meeting while they evaluated options. On 2/5 they requested to be placed back on the Legal Finance Committee agenda.

Approve Option 1 1) Determine that there are no feasible and prudent alternatives to the proposed project and the project includes all possible planning to minimize harm to historic property. This action authorizes the applicant to apply for building permits for the project plan revisions dated 11/30/17. 2) Determine that there are feasible and prudent alternatives to the proposed project and that not all planning has occurred to minimize the harm to the historic structure. This action denies the applicant the ability to apply for building permits for the project plan revisions dated 11/30/17. 3) Continue the appeal to a certain date and require the applicant to provide additional investigation or explanation of alternatives. Notes: If City Council approves the appeal adversely effecting historic property, a building permit may be issued no sooner than ten days after SHPO receives notification of the final determination, sent certified mail.
