Agenda Item Summary:
The applicant is appealing staff’s denial of a Vacation of a utility and minor drainage easement application for a property located at 4733 Apres Vous Court. The Vacation request was denied by staff on September 30, 2017. The applicant has also submitted a Variance request to Pennington County Planning to reduce the minimum required side yard setback for a garage. No calculations, grading plan, or other information was submitted to support vacating the drainage easement. If typical construction practices are utilized, it appears that the roof on the proposed structure will over-hang the adjacent property and direct drainage onto the adjacent property. In addition, the topography shows the ground sloping towards the rear lot line. Any drainage from the property will drain towards the rear lot line along their property line.
