Agenda Item Summary:
The applicant has submitted a Variance request to reduce the minimum required rear yard setback for an existing garage from 5 feet to 1.5 feet. The property is developed with a single-family dwelling and a detached garage. The applicant has also submitted a Vacation of Utility and Minor Drainage Easement (File #17VE015) application, a Vacation of a note on a plat regarding setbacks (File #17VE016) application, and a Zoning Exception (File #17ZE027) for the side yard setback to the dwelling. On April 16, 1998, a Building Permit was issued to the current property owner for the detached garage showing a 5 foot rear yard setback. The garage was constructed with a 1.7 foot rear yard setback. At the time, it appeared that the structure was located outside of the encroachment. The garage measures 640 square feet in size. A cemetery is located on the property to the north.
