Agenda Item Summary:
Currently, when the City wishes to rezone property, Rapid City Municipal Code 17.54.040 requires two rounds of disclosures to property owners four weeks apart providing a “written accounting of the estimates for any costs of subsequent zoning applications”, including detailed information about the current zoning district and possible uses and the proposed zoning district; possible fees for applications or mailings; a statement about when professional fees may be accrued; time frames for application procedures; and other detailed information. The ordinance imposes a months-long process prior to the City initiating the substantial process to rezone the property through Planning Commission and two readings by Council – a process which has its own requirements for notice, publication, and mailings to affected property owners. The proposed ordinance change would simplify the process when the City initiates a rezone, requiring one notice to the property owners with relevant information about the rezone district, its effect on the property, and the public hearings at which the decision will be made. The change recognizes that the City initiates rezones only in conjunction with another City activity which involves contact with the affected property owners, either on an individual basis or through public outreach.
