Agenda Item Summary:
The applicant has submitted a vacation of major drainage easement request to vacate a portion of a major drainage easement located in the rear yard of 13 single family residential lots. The applicant has also submitted two associated vacation of major drainage easement requests (File #16VE021 and 16VE022) for two additional lots. On October 7, 2016, the three vacation of major drainage easement requests were denied. Major drainage easements are established for the 100 year runoff for drainage ways that convey runoff from two or more lots. The existing easement serves 29 lots, with the easement centered on the rear lot line, and 10 feet of easement on each lot. A minimum easement width of 20 feet is required to allow for maintenance. A drainage swale constructed within the easement collects drainage from the 29 lots at an inlet on the north end of the block before it intersects with Vinecliff Drive. No obstructions are allowed within major drainage easements as obstructions could impact or impede drainage flows and/or create drainage issues on adjacent lots. The proposed vacation requests would create a dis-contiguous easement on the remaining 14 lots. No supporting information was provided by an engineer to support the vacation request.
