Agenda Item Summary:
This ordinance is being proposed to clarify that rezoning ordinances can be reviewed by the Planning Commission instead of the Legal and Finance Committee. As it stands today, pursuant to the implied procedure in RCMC 17.54.040 and long-time procedures allowed by Council, rezoning ordinances are thoroughly vetted by the Planning Commission and do not go through the Legal and Finance Committee. So, this ordinance would not change the status quo procedure.

Additionally, this ordinance would allow ordinances concerning zoning or subdividing to go through Planning Commission, instead of the Legal and Finance Committee, prior to being heard by the City Council. The Planning Commission already thoroughly reviews ordinances that deal with Title 17 of the RCMC, but that are not rezoning ordinances. The Legal and Finance Committee also reviews Title 17 ordinances, which is arguably duplicative and unnecessary. The Planning Commission evaluates subdivision plans, so it would also make sense for the Planning Commission, as opposed to the Legal and Finance Committee, to review ordinances that deal with Title 16 of the RCMC, which is entitled Subdivisions. This ordinance would allow Title 16 and Title 17 ordinances to go through the Planning Commission instead of the Legal and Finance Committee prior to being seen by Council.
