Agenda Item Summary:
The current AFSCME agreement provides that employees working on a holiday receive 1.5 times their regular rate of pay for hours worked. Because an employee would receive holiday pay at his/her regular rate of pay if he/she doesn’t work a holiday, employees were not incentivized to work on a holiday or to volunteer to be called in on a holiday if the need arose (such as, for example, a winter storm or a water or sewer main break). For that reason, the union and management have agreed to amend the holiday provision of the AFSCME contract, Section 23.02, to provide that employees working on a holiday will receive both the day’s holiday pay as well as premium pay of 1.5 times their regular rate of pay for hours actually worked. This amendment also clarifies that holiday pay will be used for the purposes of calculating overtime but that hours worked will not count toward overtime calculations because it is already compensated at a premium rate of 1.5 times.
AFSCME contracts prior to 2020 contained a similar provision entitling employees working a holiday to receive 2.5 times their regular rate of pay. This provision is similar to provisions in the FOP contract (Section 21.05) and the IAFF contract (Section 13.05) allowing employees working a holiday to receive 2.5 times their regular rate of pay for hours worked on a holiday.
