Agenda Item Summary:
At the December 5 Council meeting, the Council authorized the Public Works Director to accept the Reservoir Lot plat from G and Q Investments for its reservoir located east of Elk Vale Road. The dedication of that permanent Reservoir Lot satisfies the property owner’s obligations as dictated by the 2008 Covenant Agreement between the City and G and Q Investments (formerly G and G). Additionally, the property owner is dedicating new utility and access easements that replace the previously-dedicated Permanent Access and Utility Easement. Approval of this agenda item would authorize the Mayor and Interim Finance Director to sign the Release of the Covenant Agreement and the outdated easements, on the basis that the property owner has platted the Reservoir Lot and will dedicate updated easements to the City for the utilities and for the access road.
