Agenda Item Summary:
This ordinance was updated from First Reading to delete the fees from the ordinance because they are covered in the fee resolution. The 2018 SD legislature adopted HB 1070 which amended state laws governing alcoholic beverages found in SDCL Title 35, and this ordinance incorporates three primary changes. First, the ordinance amends the types of alcohol licenses to reflect the changes in state law and it adds an off-sale delivery license adopted in 2017 by the SD legislature. Second, the ordinance updates the special event permit provisions to include changes in HB 1070 and SB 178. Finally, HB 1070 also clarifies that cities have the option to restrict sales on Christmas, Memorial Day, and Sundays, and the ordinance updates the hours of operation to remove the Christmas day sales restriction.
