Agenda Item Summary:
Attached is the bleacher rental agreement within which there have been some revisions. The deleted language is in red strike-through and the proposed language is in red text.
Including some minor language maintenance of the contract, the major changes are as follows:
• Rental fee- A proposed rental fee of $200 per day of use per unit. The prior $150 rental fee per bleacher was set in 2007. This increased fee allows for needed maintenance of the bleacher units as they age.
• Out of city limits delivery – The changes to the agreement would require the Lessee to transport the bleacher units out of City limits.
• Deliver within City limits per-employee rate of $40 per hour. Previously, City employees would deliver the bleacher, set up, and take down the bleachers within City limits at no cost. However, this has included employees that may have needed to work overtime to get this accomplished.
• Mileage rate – The change from $.35/mile would increase to the current state mileage amount of $.42/mile.
• Insurance limits – Previously the agreement called for the Lesee to list the City of Rapid City as an additional insured with the General Liability limits of $2,000,000 Single Limit and $2,000,000 General Aggregate. These are very hard limits to obtain for insurance. After speaking with our insurance agents, it is recommended that we require the standard $1,000,000 Single Limit and $2,000,000 aggregate line of coverage with listing the City as additional insured.
