Agenda Item Summary:
The owners of several parcels along N. Berry Pine want to formally revoke restrictive covenants that were filed on their properties in 1955. In my opinion, the covenants have already expired by operation of law and are unenforceable anyway. However, the owners want a document in the title proving the covenants are no longer exist. The covenants impose requirements that are now covered by City land use and zoning regulations. The only reason we are involved is state law requires that the City approve the revocation of restrictive covenants. Staff has reviewed the request and supports the revocation.
