Agenda Item Summary:
This ordinance would amend the provisions concerning who can appeal a decision of the Building Official to the Building Board of Appeals. Currently, the ordinance permits any person who is aggrieved by a decision of the Building Official to appeal that decision to the Board. The changes would amend that provision to give license holders, applicants for licenses, or others who are performing work the right to appeal decisions by the Building Official related to licenses or building permits and to seek a different determination from the Building Board of Appeals. The ordinance amendment would limit the right of non-licensees, such as property owners, to bring an appeal to the Board when they are dissatisfied by a contractor’s work or have a disagreement with their contractor. The ordinance does not alter the Board’s jurisdiction over modifications to the code and approval of alternate materials, design, and methods of construction, and the Board retains oversight of such decisions.
