Agenda Item Summary:
This ordinance will update the campaign finance reporting requirements to comply with recent state law changes. One substantive change is that the Mayor and all Aldermen will be required to file an annual statement of financial interest. These statements are required for each election after nominating petitions are filed, but HB 1165, passed in the 2017 legislative session, adds the additional requirement of filling an annual updated statement of financial interest each year the elected official holds office. Other changes are to clarify existing requirements. The City has adopted the statutory requirements pertaining to county officials, but our code has made some modifications. The municipal code adjusted the timing for filing reports from the schedule in state statutes, but the reporting period for each was not specified. Additionally, a Statement of Organization is required, but is not specifically called out in the municipal code. Supplemental Reports are not addressed, nor are Amended Reports. Supplemental Reports are required by state statute when donations over $500 are received between regular reports. Amended Reports are required where there is an error or omission. This ordinance will clarify that Supplemental Reports are not required, but Amended Reports are. Lastly, there are some clean-up items added to address logistics of report filing.
