Agenda Item Summary:
On December 7, 2015, Council approved a preliminary subdivision plan for property generally located on South SD Highway 44 east of South Airport Road, now described as River Ranch Addition. Proposed Lot J of River Ranch Addition is an unbuildable lot because of the amount of floodway on the lot. A stipulation of approval for the preliminary subdivision plan requires that maintenance and ownership of Lot J be secured through a covenant agreement with the City and recorded with the final plat document. This agreement was drafted to satisfy that stipulation. It places a covenant on Lot J to inform any future owner that the lot is unbuildable (unless the floodway changes), and it burdens Lot E with maintenance of Lot J if its owners fail to maintain Lot J in the future. The agreement, once approved and signed, will be filed at the Register of Deeds with the final plat.
