Agenda Item Summary:
Annually, the City receives several million dollars from the state through direct grants and federal pass-through monies. The 2016 SD Legislature adopted changes to SDCL 1-56-10 which require recipients of grants from the State to adopt and enforce a conflict of interest policy within their organization. A recent contract between the City and the Department of Transportation incorporates this policy requirement into the terms of the contract. This policy has been drafted in response to this State requirement. It incorporates existing provisions found in state law concerning conflicts of interest for local officials who are elected and who are appointed to City boards, committees and commissions and to positions within City government.

APPROVE as attached, or APPROVE WITH ADDITIONAL LANGUAGE concerning annual disclosures: “Conflict of Interest Disclosure Form: Upon appointment, and by January 15 of every subsequent year, each Official will complete a conflict of interest disclosure form and file it with the City Finance Office. The form shall disclose any (1) source from which the Official derives income, compensation, or commission; (2) for-profit or non-profit entity on which the Official serves on the board of directors; and (3) any other relationship which the Official believes may create a conflict of interest with the Official’s position and decision-making authority. If circumstances change over the course of the year, the Official has an obligation to update the disclosure form with the City Finance Office.”
