Agenda Item Summary:
The voters of South Dakota have approved the use of medical cannabis, as well as the adult use of recreational marijuana (although that law has yet to go into effect). Staff are recommending that the smoking of marijuana in public be deemed a violation of City ordinance.
This ordinance would prohibit the smoking of marijuana in the following locations: 1) public places, 2) schools, 3) parks and playgrounds and other City-owned property, 4) any place where the smoking of tobacco is prohibited, 5) medical cannabis establishments, 6) public transportation, and 7) correctional facilities
