If you remember from the June 21, 2021 council meeting, I requested the assessment roll for clean-up assessments be amended to remove the property previously owned by Gordon Howie as it had been purchased by another party during the process and that the assessment legally goes to the property owner on record, which was no longer Mr. Howie. Ms. Kuchenbecker purchased the property (closed on 5/27/2021) and is now appealing the assessment placed on it. The City is required by State law to use the property ownership information on file at the County whenever there is a code enforcement issue and notification must be made to the property owner. The City followed this law and sent the original notifications to Mr. Howie at his mailing address on file with the property. When the City determined that he was no longer the owner, the notifications were mailed to the new owner on file. Any assessment goes with the property and, in this case, it was the responsibility of Mr. Howie to have disclosed the assessment on his property during the sales transaction, as he was notified of the property clean up with an invoice dated 4/14/2021. At this time, the City has already spent the funds to clean up the property as well as to follow the proper nuisance assessment procedures. It is staff’s recommendation to deny this appeal.
